第一章 总 则

第一条 为促进国家农业综合开发水土保持项目(以下简称“农发水保项目”)管理规范化、制度化,保证工程质量,提高投资效益,依据《国家农业综合开发部门项目管理办法》等有关规定,结合水土保持项目特点,制定本细则。

第二条 本细则适用于国家农业综合开发办公室(以下简称“国家农发办”)批准、水利部组织实施的农发水保项目。

第三条 农发水保项目是农业综合开发项目的重要组成部分,遵循国家农业综合开发的指导思想和方针政策,以保持水土、整治国土为基础,改善农业生产条件和生态环境,提高农业综合生产能力,促进经济社会可持续发展。

第四条 农发水保项目以《全国水土保持生态环境建设规划》、《国家农业综合开发水土保持项目规划》等国家和流域(区域)水土保持规划为指导,按照轻重缓急,突出重点的原则,集中投资,规模治理。

第五条 农发水保项目参照基本建设程序管理,并实行中央、流域、省、地(市)、县分级管理的制度。

地方各级水行政主管部门应与同级财政部门(农发办设在财政部门的为农发办,下同)密切配合,各负其责,互相支持,共同做好农发水保项目管理工作。

第二章 前期工作及立项审批

第六条 农发水保项目按项目区申请立项,项目区选择须符合下列条件:

(一)项目区应在《全国水土保持生态环境建设规划》、《国家农业综合开发水土保持项目规划》及流域水土保持规划确定的重点治理区内,与国家农业综合开发总体规划相衔接;

(二)按流域或区域集中连片,规模治理。每个项目区水土流失治理面积一般不少于70平方公里;

(三)当地政府重视,把水土保持工作列入领导目标责任考核内容; (四)所在地水土保持机构健全,技术力量强;

(五)有资金配套能力,项目区群众积极性高,投劳有保障。

第七条 省级水行政主管部门根据《国家农业综合开发水土保持项目规划》,编制本省(区、市)项目建设规划。

农发水保项目根据规划分期实施,每个项目实施期为三年。

第八条 农发水保项目前期工作包括可行性研究和初步设计两个阶段。

可行性研究报告以项目区为单元,由省级水利水保部门组织编制。初步设计依据批准的可行性研究报告,以小流域(或单坝)为单元,由县级水利水保部门组织编制。 第九条 可行性研究和初步设计报告根据水土保持工程前期工作有关技术规范编制,并须由具有相应规划设计或水土保持方案编制资质的单位承担。

第十条 可行性研究报告由省级水行政主管部门会同省级财政部门初审后,与省级财政部门联合报送水利部,经水利部审批后立项。未按要求联合申报或越级申报的项目,不予立项。

水利部在立项审批前,组织流域机构对可行性研究报告进行评估,其评估意见作为立项审批的重要依据;中央财政年度投资500万元(含500万元)以上的项目,项目可行性研究报告由国家农发办组织评估与审批立项。

第十一条 项目评估建立责任制。评估人员应对项目区选择的合理性、防治措施的技术可行性等做出客观真实的评价。因评估结论失实影响项目正确决策的,评估人员及其所属评估机构应承担相应责任。

第十二条 初步设计由省级水行政主管部门审批,作为施工和安排年度投资计划的依据。

第十三条 可行性研究阶段,须按照《水土保持重点工程农民投劳管理暂行规定》(水保[2004]665)的要求,落实群众投劳承诺。凡是投劳不符合有关规定、投劳不落实的项目,不予审批立项。

第三章 计划管理

第十四条 水利部按照超过国家农发办当年下达的投资控制指标10-20%的比例,根据批复的可行性研究报告和对各省项目实施的综合考核情况,会同流域机构提出下年度备选项目。在国家农发办下达下一年度项目中央财政投资控制总指标20个工作日内,在保证续建项目的基础上,从备选项目中择优选项,向国家农发办申报中央财政分省分项目投资控制指标,同时附报项目评估审定情况。

第十五条 农发水保项目计划自下而上编报。地方水行政主管部门依据项目可行性研究报告及初步设计批复情况,以及国家农发办下达的中央财政分省分项目投资控制指标,会同同级财政部门逐级编报、汇总年度项目实施计划。

省级水行政主管部门应在中央财政分省分项目投资控制指标下达后2个月内,会同省级财政部门将年度项目实施计划报送水利部,抄送流域机构,同时附送项目初步设计批复文件、省级财政部门出具的地方财政配套资金承诺文件。

第十六条 水利部会同流域机构对省级年度项目实施计划进行审查,汇总编制年度项目实施计划,于中央财政分省分项目投资控制指标下达3个月内报国家农发办批复。 水利部根据国家农发办批复的汇总计划,批复项目分省计划,并报国家农发办备案,抄送省级财政部门。

第十七条 年度项目实施计划经水利部批复后,省水行政主管部门应及时将建设任务和投资计划逐级下达到项目实施单位,并抄送省财政部门和水利部。

第十八条 年度项目实施计划一经批复必须严格执行。如因特殊情况确需变更的,须经原审批单位批准。

第二十条 农发水保项目的责任主体为县级水利水保部门,对项目建设的全过程负总责。

第二十一条 以中央财政投资为主的种苗、淤地坝和坡面水系工程、集中连片的机修梯田等单项工程,投资规模在50万元以上的,应推行招标投标制。承建单位必须具有法人资格和相应的施工能力。严禁转包和分包。

群众施工的工程,应加强施工组织、劳力安排和技术指导。

第二十二条 农发水保项目全面推行工程建设监理制。监理单位必须具有水土保持专业监理资质,由项目责任主体通过公开招标或邀请招标的方式选定。 监理单位依据合同,公正、独立、自主地开展监理工作。

第二十三条 项目实施根据《水土保持重点工程农民投劳管理暂行规定》的要求,按照“一事一议”的原则,落实群众投劳。

第二十四条 项目实施根据《水土保持重点工程公示制管理暂行规定》(水保[2004]642号)的要求,实行施工前和竣工自验后公示,并作为监督检查与验收的重要内容。

第二十五条 工程建设必须严格执行经批准的初步设计和年度项目实施计划,不得擅自变更。如因特殊情况确需变更且属布局、投资规模、主要建设内容调整的,须经原审批部门批准;不涉及总投资和治理面积,不降低质量,不影响项目功能的一般性修改应经原设计单位同意、地(市)水行政主管部门批准,报省水行政主管部门备案。 第二十六条 项目实施应开展效益监测工作。监测工作须由有相应水土保持监测资质的单位承担,监测成果及时报送上级主管部门。

第二十七条 因地制宜地推广新技术,引进新品种,加强技术培训,建立技术支撑体系,提高工程建设的质量与效益。

第二十八条 工程竣工后,应明确管护主体,及时办理移交手续,明晰产权、办理产权登记,制定管护制度,确保项目长期发挥效益。

第二十九条 农发水保项目实行“国家引导、配套投入、民办公助”的投资机制和“集中投入、奖优罚劣”的原则。以资金投入控制项目规模,按项目管理资金。

第三十条 项目资金多渠道筹集,包括中央财政资金、地方财政配套资金、农村集体和农民群众自筹资金等。

地方财政配套资金不落实的,将根据情况调减下年度的中央财政资金规模。 第三十二条 项目财政资金主要用于坡地及沟道整治、土壤改良、保土耕作、田间道路;拦引蓄灌排小型水利水保工程等所需的材料、设备、机械施工补助及技工工资;营造水土保持林草、 经济林所需的种子、苗木、整地、定植及幼林管护、封禁治理、苗圃建设;科技推广、技术培训、效益监测及小型仪器设备购置等费用。

第三十三条 用于项目前期及建设管理等费用,严格执行农业综合开发财务管理的有关政策规定。其中:项目可行性研究和初步设计费、工程建设监理费、科技推广费、幼林管护费分别按财政资金总额的2%、2%、7.5%和2%控制,在地方财政配套资金中列支。

第三十四条 农发水保项目实行财政资金使用报账制度,并按照财政部《农业综合开发资金报账实施办法》执行。

第三十五条 项目财政资金严格按照农业综合开发财务、会计制度进行管理,实行专人管理、专账核算、专款专用,及时足额拨付,按规定范围使用资金,严禁挤占挪用。 第三十六条 严格执行各项财经管理制度,建立健全内部监督制约机制。加强资金使用的追踪检查,定期对资金的拨付、到位、使用情况进行审计,发现问题及时纠正,问题严重的要严肃处理。

第六章 检查验收与档案管理

第三十七条 农发水保项目验收包括年度验收和竣工验收。验收结果作为安排下年度或下一期农发水保项目中央财政投资的依据。

年度验收工作由省(或委托地级)水利水保部门会同省(或地级)财政部门组织,在县级水利水保部门自验的基础上进行。自验要对各项治理开发措施的数量、质量,逐项、逐地块进行全面的验收,对单项工程做出总体评价,并提出年度自验报告。年度验收按项目对各项措施进行抽样验收,抽样比例不得少于20%,淤地坝、坡面水系、集中连片的机修梯田等工程要逐个进行验收,并对验收结果做出评价,提出验收报告。 第三十八条 在项目实施三年期满后,由水利部组织竣工验收,地方财政部门参与。竣工验收的主要内容是:

(一)项目建设任务及投资是否按计划完成;

第四十六条 本细则由水利部会同国家农发办解释。
