诚实信用原则下的先合同义务与工程招投标
摘要：合同法依据诚实信用原则，从动态的合同关系出发，扩张了法律所调整的合同义务，将工程招投标中的先合同义务纳入了合同法律的保护视野中。现在，建筑工程招投标已成为工程承发包的主要形式。建筑工程招投标活动，实质是招标方与投标方的缔约过程，应当遵循合同的诚实信用原则。

abstract: according to the contract law honesty and credit principle, from the dynamic relations of the contract, the expansion of the law which adjust contract, will be the first project biding contract obligations into a contract in the field of the protection of the law. now, the construction project bidding has become the main form of project contracting. construction project bidding activities, essence is tender inviting party with the bidding process of the contracting parties, shall abide by the principle of good faith of the contract.
