租赁合同

TENANCY AGREEMENT

1.出租人: (以下简称甲方)

Landlord: (here in after referred to as Party A)

3.租赁标准: Tenancy:

现甲方愿意出租及乙方愿意承租位于中国北京市 朝阳区 公园大道4#-1—7C 之物业及其设施作 居住 用途,面积约 177 平方米。

Party A shall let and Party B shall take the Premises and its facilities situated in Park Avenue 4#-1—7C (Building) Chaoyang (District),Beijing,P.R China with an area of about 177 square meters for residential use in clean and tenantable condition.

4.租赁期: The Term:

4.1租赁期为 24 个月,自 2009年 6 月 12 日起至2011 年 6 月 11 日止。

Period of 24 months, commencing on June 12 ,2009 and expiring on June 11,2011 .

4.2租赁期满,甲方有权收回全部出租房屋及其设施,乙方应如期交还,乙方要求续租,须在本合同期满前一个月向甲方提出申请,并有优先租赁权。

Upon expiration, Party A is entitled to recover vacant possession of the Premises. Party B must return the Premises on or before the expire date Party B can apply for tenancy renewal by giving month advance written notice to Party A.

5.租金: Rent:

5.1租金每月为 美元/13500 人民币。

The month rental is US$ /RMB 13500 .

5.2房租支付方式为 月 付,应于每付款月前五天支付当月租金,如乙方过期未付,须按日加租金0.5%滞纳金,超过十五天未付视作自动退租并按本合同书条款规定办理.

Rental payment is settled for per month and is to be paid within 5 days before the beginning of every consecutive calendar month. If Party B defaults to pay rent, Party A has the right to claim for interest at the rate of 0.5% of daily rent If payment is overdue over 15 days, Party B shall be regarded as terminating the tenancy automatically and party A is entitled to claim

for the liquidated damages pursuant to coarse 9.2 harem contained. 5.3在合同有效期内,租金不予调整。

In the period the Tenancy Agreement, the rent will not be changed.

6.押金: Deposit:

6.1在本合同签订之日起,乙方应向甲方缴付 贰个 月租金押金共计 美元/ 27000 人民币,本合同期满乙方如不再续租,甲方应将押金全部退还。

Party B shall in the day after the signing of this tenancy have paid to party A in the amount of US$ 27000 RMB as security deposit, upon expiration of the tenancy Party A

shall Refund the total security deposit.

6.2乙方如在租赁期内终止租约,押金不予退还。

If Party B terminates the tenancy. security deposit will be forfeited.

7.其它费用:

Other Charges:

7.1乙方在租赁期内所用水、电、煤气按单缴付。

During the term of the tenancy, party B shall pay for water, electricity and gas charges of the Premises and party B must settle the bill accordingly. 7.2乙方所用电话按电讯局收费标准,并按单缴付。

Party B shall pay for telephone charge in accordance with the payment scale as stipulated by the Telephone Bureau And party B must settle the bill accordingly. 7.3物业费由 甲方 支付。

Party A Pays for the management fee..

8.出租人责任:

Landlord’s Responsibilities:

8.1租赁期内甲方不得无故收回房屋, 如甲方中途要求收回房屋, 乙方可以拒绝,协商不成,

甲方应有所赔附并退还押金。 During the continuous of the tenancy, party A shall not take possession of the premises without any reason. If party A requests to take possession of the premises. Party B shall refuse for such request.

8.2租赁房屋内各项设施如上下水, 暖气等设施损坏, 甲方有义务与该物业管理部门联系, 进行维修及处理。

If there is any damage of the common facilities in the leased property, party A should contract with the management department and deal with them in time.

9.租赁人的责任:

Tenant’s Responsibilities:

9.1租赁期内未经甲方同意, 乙方不能转让其所租房屋, 私自转让无效。

Party B shall have no right to suds-let or let in part of in full of the premises to a third party without the consent of party A.

9.2乙方应爱护房屋及其设施,如因使用不当导致损坏应负责赔偿。

Party B shall keep all the interior the premises in good condition in the event of any damage of the fixture, facilities, furniture caused by party B party B shall reimburse to party B ,party B shall

reimburse to party A all repairing costs and expenses incused.

9.3乙方不得使用甲方提供的房屋进行违法活动,储藏违法物品或危险物品。

Party B can’t do any illegal activity in the leased property by party A and any illegal or dangerous Articles is forbidden.

9.4在房内有的装饰和设施之外,乙方如要增加设备或其它装修需征得甲方同意,租赁期满 必须恢复原状,并承担其费用,经甲方验收认可后还甲方。

Party B must have the consent of party A before making any alteration of the interior or facilities of the premises party B shall have to return the premises to party A in its original condition upon expiration of the tenancy.

10.争议的解决:

Arbitration:

凡执行本合同或本合同有关大争议,由双方友好协商解决,协商不成,提请北京仲裁委员会协调,如乙方对仲裁结果不满,可寻求其他法律形式解决。

Both parties shall settle any dispute in a friendly manner and in good faith. If no agreement can be made, either party shall submit the case to the related economic contract Arbitrated Bureau of China for arbitration.

11.其他:

11.1本合同如有未尽事宜,由甲、乙双方商定另行补充。本合同及一切补充均作为本合同组

成部分,具有同等法律效力。 Party A and party B can supplement others if some clauses are exclusive in the Agreement and supplement is regarded as the part of the Agreement and has the same validity.

11.2本合同自签字之日起生效,合同文本一式三份,甲乙双方及代理方各执一份。

The Agreement will be valid after the signing and there shall have three copies of this Agreement Each Party shall keep one copy of it.

补充条款:Supplement:

一.甲方承担乙方一个人的会所使用费用,一个车位的使用费用。 Party A Pays for one-member club fee and one car park fee..

二.甲方为乙方开通有线卫星电视并承担相关费用。

Party A open satellite TV for Party B and pays for the opening fee.

三.若乙方未履约期满而解约,由乙方退还甲方为乙方办理的会所使用卡中的金额。 If Party B has expired before the contract term , Party B should return the amount in the club card which is transacted by Party A. 四.甲方在客房为乙方添置一个1.5米*2米的标准床。
