我国招投标制度中存在的问题与解决对策

【摘 要】招投标制度是规范招投标行为的基础保障，对各个领域的有序发展起着重要的规范与约束作用。近年来，我国的市场经济水平不断提高，市场经济体制下招投标制度存在的一些问题逐渐暴露出来，需要相关部门积极采取合理的措施进行完善，以促进我国社会与经济的良好发展。
【Abstract】The bidding system is the basic guarantee for the protection of the bidding behavior， and plays an important role in the orderly development of various fields. In recent years， the market economy of our country has been continuously improved， some problems existing in the bidding system under the market economy system gradually exposed， and the relevant departments should take reasonable measures to perfect it so as to promote the sound development of our society and economy.

招投标是商品经济发展的必然产物，通过规定的组织程序授予合同，并且具有激烈竞争的一种交易方式。目前，招投标在众多领域中得到了广泛的应用，并发挥了重要作用。随着我国市场经济体制的日臻完善，市场竞争日益激烈，现行的招投标制度已无法满足新时期各种招投标行为的需求，如何完善招投标制度，切实发挥招投标制度的重要作用，保障招投标活动的有序、高效开展，成为政府及有关部门需要深思和探讨的重要课题。 2 我国招投标制度存在的问题分析 2.1 监督管理体制不协调
目前，我国招投标的管理体制是混合监管形式，分散管理与综合管理相结合，虽然此体制明确了各个领域的执法部门与职权范围，但招投标管理办法以及招标代理机构的资质认证标准是由各主管部门自主制定的，造成管理办法与认证标准统一[1]。另外，分散管理体制无法充分发挥国家发改委的执法与监督综合平衡职能，使招投标监管体制背离了精简、统一的行政原则。
