ARRANGEMENT

ON

IMPORT AND EXPORT FISHERIES HYGIENE AND SAFETY BETWEEN

THE GENERAL ADMINISTRATION OF QUALITY SUPERVISION,

INSPECTION AND QUARANTINE

OF THE PEOPLE’S REPUBLIC OF CHINA

AND

THE MINISTRY FOR FOOD, AGRICULTURE, FORESTRY AND

FISHERIES OF REPUBLIC OF KOREA

The General Administration of Quality Supervision, Inspection and Quarantine(AQSIQ) of the People's Republic of China and the Ministry for Food, Agriculture, Forestry and Fisheries (MIFAFF) of the Republic of Korea (hereinafter referred to as “the Parties\mutual cooperation on import and export fisheries hygiene and safety between the Parties, have agreed as follows:?

Article 1?

The Parties shall promote cooperation in the field of hygiene and safety of fisheries products in accordance with the relevant laws and regulations of both countries on the principles of equality and mutual benefit.?

Article 2

The Parties shall cooperate through, inter alia, the following:?

1. Guaranteeing hygiene and safety of the fisheries products that either Party exports to the other; 2. Exchanging information on the laws, regulations, technical standards and their enactment, revision and enforcement related to the hygiene and safety of fisheries products;

3. Enabling visits to the country of the other Party by officials and experts of either Party to facilitate the exchange of information and knowledge on the inspection of fisheries products; 4. Any other areas of cooperation.

Article 3

This Arrangement shall apply to the following edible fisheries products: 1. Raw aquatic animals, except for living aquatic animals;

2.Aquatic animals that were processed through cutting, heating, cooking, drying, salting or brining

(without using food additives or other materials except for edible salt), however, the original form of these products is distinguishable from exterior features.

Article 4

Registration of the fisheries processing establishments: Provided that the hygiene conditions of the fisheries processing establishments of the exporting Party meet the hygiene and safety standards of the importing Party, and the processing establishments of the exporting Party register with the Inspection and Quarantine Agency of the exporting Party, and the Inspection and Quarantine Agency of the exporting Party notifies its counterpart of the list of its registered fisheries processing establishments, the importing Party shall accept the list so as to simplify its hygiene inspection of the imports from those registered establishments.

1. The Inspection and Quarantine Agency of the exporting Party shall examine the hygiene conditions of its registered processing establishments on a regular basis and keep record of the results so as to ensure that the hygiene and safety standards of the importing Party are duly met.

2. The Inspection and Quarantine Agency of the exporting Party shall monitor on a regular basis, to determine whether any substance harmful to human health, as defined by the importing Party, is included in the process of fisheries production, and keep record of the results.

3. The Inspection and Quarantine Agency of the importing Party may conduct random inspections to the registered processing establishments so as to ensure the implementation of this Arrangement.

Article 5

The label shall be printed or marked on the packages of fisheries products using the language of importing country and English. The label shall include the information such as the product name, country name and the name and registration code of the processing establishments. The label shall be clear, obvious and indelible.

Article 6

The Inspection and Quarantine Agency of the exporting Party of the fisheries products shall submit health certificates (Appendix 2) issued by the Inspection and Quarantine Agency of the exporting Party to ensure that neither the bacteria or substances toxic/harmful to human health, as defined by each party, nor harmful substances(Appendix 1) such as foreign metal substances is included in the fisheries products. ?

Article 7

Provided that hygiene and safety problem is found in imported products, the Parties shall take measures according to Appendix 3. If necessary for the hygiene and safety of the products, the Parties may mutually conduct the joint inspection through the consultation between the Parties.

Article 8

The Party sending its officials and/or experts to the country of the other Party shall bear the expenses of travel and accommodations.?

Article 9

The Parties will notify each other of the completion of their domestic procedures necessary for implementing this Arrangement and this Arrangement will come into effect on the date of the later notification. The Arrangement shall remain in force for an initial duration of five years, and continue in force thereafter for a subsequent period of five years unless either Party notifies the other Party in writing six months in advance of the intention to terminate it.?

Article 10

1. This Arrangement may be modified or revised by the Parties through consultation.

2. This arrangement will replace the Arrangement signed by the State Administration for Entry-Exit Inspection and Quarantine of the People’s Republic of China and the Ministry of Maritime Affairs and Fisheries of the Republic of Korea on 5th day of April 2001 in Beijing of China.

Done at Seoul on the 25th of August 2008, in two original copies, each in Chinese, Korean and English languages, all texts being equally authentic. In case of divergence in interpretation, the English text shall prevail.?

If the importing party establishes new inspection standards, it will notify the exporting party of the standards and allow a reasonable period for the exporting party to prepare for compliance with the standards in accordance with WTO/SPS regulations.
