Offer 报盘

I. Introduction(导入)

Talk about the difference between the following terms(比较两对术语的差异) A. Quatation and offer.

A quotation is a response to an enquiry,it is a statement of the prevailing prices of goods and services.The supplier is willing to provide goods and service at the prices on the terms and conditions mentioned in it. A quotation sheet will will be sent to the prospective importer by the exporter after he receives an enquiry from the foreign buyer.

A satisfactory quotation will include the following: An expression of thanks for the enquiry Commodity Price Quantity

quote意为“报价”,只涉及价格。

The new crop is quoted on the Cotton Exchange at £30 per ton. 棉花交易所中新货报价为每吨30英镑。

In case of offer, please quote us your lowest price in US dollars. 报盘时,请以美元开最低价。

Offer

An offer is an expression in which its offeror is willing to conclude a transaction with an offeree on the terms and conditions mentioned therein during its valid period. It can be classified into two categories: firm offer and non-firm offer.

The former involves the exporter in contractual obligations , while the later does not. This is the first step in business negotiation. An offer includes the following points: ? Commodity ? Specification ? Quantity ? Unit Price ? Packing ? Shipment ? Payment

B. Firm- offter and nonfirm offer

? Firm offers受盘人在有效期内表示完全同意,交易立即达成的报盘

为实盘。表示 有效期的方法:

Firm offers are promises to sell goods at a stated price and within a stated period of time. The promise may be express (i.e. clearly stated in words ), as when it takes the form of a letter, or it may be implied(i.e.

understood), as when it takes the form of a quotation that contains the words “ For accepance within…days” or similar qualifying words.

c. Non-confirm offer: non-firm offer 虚盘

发盘人没有肯定的订立合同的意旨,例如反映在发盘内容不明确(Not clear),或者主要条件不完备(Not complete),或者不是最后的(Not final),这种发盘对发盘人无约束力(Without engagement)。Usually there is one of such expressions: ? Subject to our final confirmation ? Subject to prior sale

? Subject to the good being unsold ? Subject to the change without notice ? We are ready to sell A…

我方准备卖A商品。We offer…subject to our final confirmation. 我方报盘……(各项交易条件)……以我方最后确认有效。 We make you an offer subject to the goods being unsold. 我方向你方报盘,以未售出为准。

A firm offer, although not legally binding, is capable of acceptance and once it has been accepted, it can not be withdrawn, but no reputable seller would risk his reputation by withdrawing his offer before the stated or agreed time. In making a firm offer, mention should be made of the time of shipment and the mode of payment desired; in addition, an exact description of the goods should be given and, if possible , sample sent.
