代负责任又称雇用者责任或雇用人侵权责任, 是指雇用人对其受雇人从事职务时, 因侵权行为致他人遭受损害应负赔偿责任。原《道路交通事故处理办法》第三十一条的规定即是典型的代负责任。该条规定: “机动车驾驶员在执行职务中发生交通事故, 负有交通事故责任的, 由驾驶员所在单位或者机动车的所有人承担赔偿责任; 驾驶员所在单位或者机动车的所有人在赔偿损失后, 可以向驾驶员追偿部分或者全部费用。”代负责任与连带责任是两个容易混淆的概念, 但二者是有较大区别的:
1. 连带责任情况下, 受害人可以选择向承担连带责任的各方求偿, 承担连带责任的一方在清偿了债务后, 可以向其他连带债务人追偿。代负责任情况下, 受害人只能向雇用人求偿, 雇用人在赔偿损失后, 可以向雇员追偿。
