我国现行夫妻约定财产制 存在的问题及其完善
摘 要
夫妻约定财产制是在夫妻法定财产制的基础上，随着社会的进步，经济的发展，妇女地位的提高以及当事人意思自治等民法基本理论的确立而逐步建立起来的。它体现了男女平等、尊重婚姻个体意志等法治理念。我国2001 年修改后的《中华人民共和国婚姻法》在原有夫妻约定财产制的基础上，进一步完善了该制度，婚姻当事人可以优先选择约定财产制，充分体现了意思自治的原则，并开始注重对第三人利益的保护。这是我国《婚姻法》的重大发展，但其在约定时间、内容、形式、可否变更和撤销等方面的规定还过于简单，缺乏系统性、可操作性，给实践运用带来了不便。因此，我国夫妻约定财产制还需要进一步完善。
本文主要从以下几方面进行论述：
第一部分，我国夫妻约定财产制历史发展与现状。
第二部分，分析我国目前夫妻约定财产制存在的主要问题，并结合外国法律来分析我国法律规定的不足。
第三部分，对我国夫妻约定财产制的完善进行思考，并提出相关建议。

Abstract
Agreed Marital Property Regime is created on the basis of the legal property system, with social progress, economic development, the advancement of women and civil law such as party autonomy in the establishment of the basic theory gradually. It reflects the equality between men and women, respect for marriage and the will of the individual. In 2001, revised the marriage law of the PRC in the old marital property system to improve the system, the marriage party prefers engagement property system, fully embodies the principle of party autonomy, and begun to focus on the benefits of protection. This is our country the marriage law of a significant development, but its appointed time, content, forms, can change and revocation, and other requirements are simple, the lack of systematic, operability, to practice brought inconvenience, marital property system also needs further improvement.
This paper mainly discusses the following aspects:
The first part, introduce the historical development and current situation of the Agreed Marital Property Regime in China.
The second part, analysis of the Agreed Marital Property Regime in the current main problems, combined with foreign law analysis of the law inadequate.
The third part of perfected the Agreed Marital Property Regime in China for reflection and suggestions.
