摘 要
2007 年，随着《中华人民共和国物权法》的颁布实施，业主撤销权制度在我国得以确立。由于这一制度从确立至今不过四年有余，故有关该制度的很多问题，如业主撤销权的性质、行使的主体、条件、行使期限、效力等均存在争议。本文对我国业主撤销权行使存在的若干法律问题进行了探讨，并对我国业主撤销权制度的完善进行了深入思考，并提出了自己的观点。本文分为以下四个部分：
第一部分是案例简介以及争议问题的提出。这部分将介绍广州市和西安市两起物业管理纠纷案件，并总结案件中存在争议的问题，提出本文要分析的重要问题。
第二部分是分析我国撤销权行使中存在的主要法律问题的。一是分析了业主撤销权的性质。二是分析了行使业主撤销权的权利主体以及行使对象，主要对房屋承租人、借用人、房屋继承人、夫妻共有房屋未登记一方等物业实际使用人能否行使撤销权以及业主大会或者业主委员会能否成为行使对象的问题作出了分析。三是分析了业主撤销权行使的条件，对业主大会或者业主委员会的决定程序违法和实体违法作出了分析。四是对业主撤销权行使的法律效力作出了分析。并就以上问题提出了自己的观点。
第三部分是提出我国业主撤销权行使的立法完善建议。一是建议明确行使业主撤销权的权利主体。二是建议明确业主撤销权行使的条件。三是建议应对业主撤销权的行使期限做适当修改。四是建议立法应对第三人利益的保护作出规定。 五是建议我国对业主权利的保护应采取事前预防与事后弥补相结合的保护模式。

LEGAL ANALYSIS ON THE EXERCISING OF THE OWNER’S RIGHT OF REVOCATION IN OUR
COUNTRY Abstract
In 2007, with the carrying out of \system of the owners' right of revocation was established in China. Because it’s only a little more than four years science the establishment of the system, it exists a lot of problems, for example, the nature, subject, object, exercise duration, and the scope of validity of the owners' right of revocation are controversial. This article discusses the issues in the judicial practice about the system of China's owners' right of revocation, and the writer also thinks over the improvement of the system of China's owners' right of revocation, and puts forward his own viewpoints as well. This paper is divided into the following four parts:
The first part is the brief introduction of the case and the putting forward of the controversial issues. This section will introduce two property management disputes in Guangzhou and Xi'an, and sum up the controversial issues in the case, coming up with the important issues to be analyzed.
The second part is the analysis of the main legal issues about the exercising of China's owners' right of revocation. First it analyzes the nature of the owners' right of revocation. Second, it analyzes the subject and the of the right, mainly analyzes if the actual property users, such as the lessee, borrower, housing heirs, the matrimonial housing unregistered party can exercise the right of revocation and if the owners' assembly or the owners' committee can become the objects. Third, it analyzes the conditions of the exercising of the right, and also analyzes the procedure violation and the entity violation in the owners' assembly's or the owners' committee 's decision. Fourth, it analyzes the legal effection of the right's exercising. And at the same time, the writer puts forward his own point of view on the issues above.
The third part is to put forward the legislative suggestions on the improvement of our country's exercising of the owners' right of revocation. One of the suggestions is to make clear the subject in the exercising of the right. The second is to make clear the conditions in the exercising

of the right. The third is to appropriately modify the exercising period. The four is the legislation regulations should protect the interests of the third parties. The fifth is that we should take the protection mode of the combination of prevention beforehand and making –up later to protect the owners' rights in our country.
