非市场经济地位对我国反倾销应诉的影响分析及
对策探讨
摘要
为了尽早加入WTO，《中华人民共和国加入议定书》的第15条规定：十五年内，中国在外国反倾销调查中可以被视为非市场经济国家。因此，在对我国提起的反倾销调查中，以欧美为首的西方国家为了不同的政治和经济利益，拒绝承认中国的“市场经济地位”，从而在反倾销裁决中，确定我国涉案产品的正常价值主要采用替代国制度，使我国企业在应对反倾销调查中处于极为不利的境地，给我国的经济利益造成了重大的损失，对我国经济的发展造成了重大的不利影响。
本文分析了非市场经济问题的由来、判定标准、法律依据及其实质，在此基础上，对中国的非市场经济地位问题进行理性分析，正视我国市场经济体制的不足，认清市场经济实际评估的困境; ;探讨建立一个各有分工、各负其责、协调统一的，由政府、企业和行业协会组成的三位一体的应对反倾销的机制，以期对中国企业的应诉工作有所裨益

The impact analysis and strategy discussion of non-market economy status to China's anti-dumping
Abstract
In order to enter the WTO earlier, article 15 in the Protocol of China’s accession to the WTO says: foreign countries may regard China as a non-market economy country in the cases of anti-dumping during the coming fifteen years. Therefore, western countries such as the EU and the USA refused to approve Chinese market economy status because of political and economical factors in anti-dumping investigations against China. They mainly apply “Subrogate Country” to calculate the normal value of Chinese goods in adjudicating anti-dumping cases, which brought forth much difficult to Chinese enterprises’ reply to accusations. It also caused serious damages to the economic benefits and the development of economic of China.
The dissertation analyzes the origin，Standards of judge，legal grounds as well as. On the basis of that，the dissertation goes on with a rational analysis of the issue of NME Status of China, makes a list of weak points of the market economy system of China and faces directly the difficulty in actual evaluation of market degree. Finally，the dissertation puts forward a variety of constructive countermeasures for Chinese export enterprises to fight against international antidumping.
