摘要
近年来,我国的工程建设和建筑业有了很大的发展,但由于没有一套有效的保证体系或风险转移制度来约束业主和承包商的行为以规避风险,结果出现了很多问题,如工程质量问题,工程款拖欠问题等,特别是合同的履约方面。工程保证担保作为国际上保障建设承发包合同履行的一种信用工具已经实行了一百多年,特别是在防范信用风险方面起着不可替代的作用,因此对其研究有着非常重要的理论现实意义和应用前景。
工程保证担保就是在工程建设领域中引入一个新的主体—保证担保人,与工程建设的另外两大主体业主和承包商一起构成一个新的三方主体。从而可以充分利用市场经济的基本运行模式,通过三者之间的利益制约和市场信用机制的建立,来达到对建设市场的规范管理。
本文的研究主要包括以下几个方面:第一,本文对于工程保证担保基础理论的研究从其概念入手,探讨了我国工程担保制的现状;第二,在分析了现状基础上着重研究了我国工程担保制目前存在的问题,以及形成这种问题的原因。第三,针对目前我国工程担保制存在的问题,提出应对策略。
总体来说,我国的工程保证担保制度还在发展和完善阶段,虽然仍有诸多问题,但是发展的前景是乐观的

Abstract
In recent years, China's construction and building industry has been greatly developed, but the absence of an effective guarantee system or risk transfer system to restrain the behavior of owners and contractors in order to avoid risks, resulting in many problems, such as engineering quality, project payment arrears problems, especially in terms of performance of the contract. Surety as a guarantee of the international community to fulfill the construction of the construction contract a credit instrument has been practiced for over a century especially plays an irreplaceable role in the prevention of credit risk, so its research has a very important theoretical significance and application prospects.
ASSURANCE is the introduction of a new subject in the construction field - the guarantee guarantor, and the construction of the other two main owners and contractors together constituting a new tripartite body. Which can make full use of the basic mode of operation of the market economy, constraints and interests through the establishment of market credit mechanism between the three, to achieve standardized management of the construction market?
This study includes the following aspects: First, the article for the study of the basic theory of project guarantees to ensure its concept paper discusses the present situation of engineering guarantee system; second, in the analysis of the current situation on the basis of the project focuses on the guarantee system existing problems, and the reasons for this problem. Third, for the current guarantee system of engineering problems put forward countermeasures.
Overall, China's engineering guarantee system is still in the development and improvement stage, although there are still problems, but the prospects for development is positive.
