我国建筑物共有权纠纷解决规则研究

摘 要

随着我国城镇化进程加快和城市人口增多,因建筑物共有关系而引发的纠纷与日俱增。我国虽相继通过了《物权法》、《建筑物区分所有权解释》、《物业服务纠纷解释》,但现实纠纷形式已经摆脱了现有法律的规定,各种新式的建筑物共有权纠纷频频出现,尤其表现在法律规定的建筑物共有部分的一些特殊范围的权利归属,如车库(车位)、绿地、道路等建筑物共有部分;立法保护和纠纷解决规则等方面尚不成熟。因此,本文以“三元论”说为理论基础,以实地调查为现实根据,借鉴德国和日本的转移或拍卖请求制度等成熟的先进立法理论,对共有部分范围采取“排除与列举、推定相结合”的识别模式,对建筑物共有权的基本概念、基本内容、立法保护等方面进行探讨,以期提出更加科学合理的建筑物共有权理论体系和立法措施,为解决实务纠纷提供参考。

Research on the rules of building the right to dispute settlement

in China Abstract

As the process of urbanization and the increase of population in China, the disputes caused by the building of a total of the buildings are growing.Our country although have passed the property law, the distinction between ownership of the buildings to explain ,\property services Disputes Interpretation \existing laws, all new buildings were entitled to disputes occur frequently, especially in the legal provisions of the buildings were part of the some range of special rights of ownership, such as garage (spaces), green spaces, roads and other buildings were part of; legislative protection and dispute settlement rules and so on is not mature. Therefore, this article to \theory\said as the theoretical basis, to the investigation into reality, learning from Germany and Japan the transfer or sale request system mature advanced legislation theory, the common part take \and enumeration, combining the presumption of\pattern recognition, the building were entitled to the basic concepts, basic content, legislative protection of ownership of the building more scientific and reasonable theory system and legislative measures are proposed in order, to provide reference for solving practical disputes.
